1. Acceptance of Terms

By accessing or using the website at imperialbeachfence.com, contacting Quality Imperial Beach Fence for services, or entering into a service agreement with us, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services. These terms apply to all visitors, customers, and others who access or use our services.

2. Description of Services

Quality Imperial Beach Fence provides residential and commercial fencing installation, repair, replacement, and related services in the Imperial Beach, CA area and surrounding communities. Services include but are not limited to wood fence installation, vinyl fence installation, chain link fencing, aluminum fencing, privacy fencing, pool fencing, custom fence design, ornamental iron fencing, automatic gate installation, security fencing, farm and ranch fencing, pet fencing, fence repair, fence replacement, and fence staining and sealing.

All services are subject to a separate written agreement, proposal, or contract between Quality Imperial Beach Fence and the customer. These Terms and Conditions apply in addition to, not in place of, any such project-specific agreement.

3. Estimates and Pricing

All estimates provided by Quality Imperial Beach Fence are based on the scope of work as described at the time of the estimate. Written estimates are valid for 30 days from the date of issue unless otherwise stated. Estimates are not final contracts and do not guarantee the availability of labor or materials at the quoted price after the expiration date.

If the scope of work changes after an estimate is accepted - due to unforeseen site conditions, changes requested by the customer, or factors outside our control - Quality Imperial Beach Fence reserves the right to adjust pricing accordingly. Any such changes will be communicated to the customer in writing before additional work proceeds.

4. Scheduling and Cancellation

Appointments and project start dates are scheduled based on availability. Quality Imperial Beach Fence will make reasonable efforts to honor scheduled dates, but delays may occur due to weather, material availability, or other circumstances beyond our control. We will notify you as soon as possible if a scheduled date needs to change.

If you need to cancel or reschedule an appointment, please contact us at least 24 hours in advance. Cancellations made less than 24 hours before a scheduled appointment may result in a cancellation fee as outlined in your project agreement. Work already completed or materials already purchased at the time of cancellation may be billed accordingly.

5. Payment Terms

Payment terms are outlined in each individual project agreement or proposal. Unless otherwise specified in writing:

• A deposit may be required prior to work beginning
• Final payment is due upon completion of the project
• Accepted payment methods will be specified in your project agreement

Accounts not paid within the terms specified in the project agreement may be subject to late fees. Quality Imperial Beach Fence reserves the right to suspend or stop work on any project where payment is overdue.

6. Customer Responsibilities

As a customer, you are responsible for:

• Providing accurate information about your property and project requirements
• Ensuring reasonable access to the work site on the agreed-upon date
• Disclosing the location of underground utilities, irrigation systems, or other hidden features that could be affected by fencing work
• Obtaining any required homeowner association (HOA) approvals prior to work beginning
• Confirming property boundary lines before installation if required for your project

Quality Imperial Beach Fence is not responsible for damage to underground utilities, irrigation lines, or other hidden features that were not disclosed prior to work beginning.

7. Permits and Compliance

Some fencing projects may require permits from local or county authorities. Quality Imperial Beach Fence will advise you of permit requirements as part of the project planning process. Unless otherwise agreed in writing, responsibility for obtaining and paying for required permits rests with the property owner. Work will not begin until required permits are obtained.

8. Warranty Disclaimer

Quality Imperial Beach Fence warrants that all work will be performed in a professional manner consistent with industry standards. Any warranty terms specific to your project will be outlined in your written project agreement.

Except as expressly stated in a written project agreement, Quality Imperial Beach Fence makes no warranties, express or implied, regarding the fitness of materials for a particular purpose, merchantability, or results. Manufacturer warranties on materials and products are separate from any workmanship warranty provided by Quality Imperial Beach Fence and are subject to the manufacturer's own terms.

Warranty coverage does not apply to damage caused by acts of nature, improper use, neglect, vandalism, or modifications made by parties other than Quality Imperial Beach Fence after project completion.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Quality Imperial Beach Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services or website, even if we have been advised of the possibility of such damages.

In all cases, our total liability to you for any claim arising from or related to our services shall not exceed the total amount paid by you to Quality Imperial Beach Fence for the specific service giving rise to the claim.

10. Website Use

While we make reasonable efforts to keep information current and accurate, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, or reliability of any information on this site.

You may not use our website in any way that violates applicable local, state, national, or international laws or regulations. Unauthorized use of this website may give rise to a claim for damages and may also be a criminal offense.

11. Dispute Resolution

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing any other legal remedy. Any unresolved disputes shall be subject to the jurisdiction of the courts located in San Diego County, California.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in San Diego County, California for the resolution of any disputes.

13. Changes to These Terms

Quality Imperial Beach Fence reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms. Please review this page periodically to stay informed of any updates.
